Justice to Jews: No Bail, Go Directly to Jail

The Wall Street Journal reports today that the U.S. Justice Department has denied bail to an American citizen because he is Jewish.
Justice reasons that because Jews over the world are able to immigrate to Israel based on that nation's Law of Return, being Jewish in America makes one a flight risk. Being Jewish, says a U.S. prosecutor, makes one virtually a dual citizen of the United States and Israel. Therefore, bail should be denied on the basis of a Jew's religion.
The Journal quotes the prosecutor:
"If defendant were released, he would easily be able to immigrate to Israel under Israel's right-to-return law, and would be allowed what essentially is...as a practical matter, dual citizenship," Assistant U.S. Attorney Peter Deegan Jr. said at a Nov. 19 hearing.
If this ruling is allowed to stand, it would thus make the accusation of "dual loyalty" among American Jews no longer an anti-Semitic canard, but a tenet enshrined in American jurisprudence.
By extension, it would also make racial/religious profiling legal, so long as those being profiled are Jewish and not Muslim.
Ironically, this ruling would presumably apply to the head of the Justice Department, Attorney General Michael Mukasey, who, like the defendant denied bail in the recent ruling, is an Orthodox Jew.
The ruling also immediately puts into question the legal status of incoming White House Chief of Staff Rahm Emanuel. Emanuel has been accused throughout the Arab world of being an agent of Israel. The recent Justice ruling would, in effect, confirm this accusation, thereby imperiling Emanuel's legal qualifications to be President Obama's chief advisor.

I don't see that this is exactly as bad as presented. Because according to the article two men already charged had fled, leading the prosecution to believe this man would do as his comrades had done. I don't see this is starting anything new, or creating new anti-Jewish legislation.
I could be misreading things of course, and be completely and utterly wrong.

The usual tactic to prevent fleeing the country is to take away the passport. To disregard this option due to someone's religious affiliation is illogical. I therefore believe it does amount to anti-semitism.
